The legislature has expanded the information requirements for the purchase of real estate by foreigners. Notaries are now obliged to submit to the Ministry of Interior, Warsaw. Also, notarised contracts for the sale of shares, shareholder shares or rights and obligations on the basis of which foreigners become owners or co-owners of commercial properties in Poland.
In addition, the law also provides that the public authorities must pass final resolutions on the basis of which foreigners acquire real estate in Poland, to the Ministry of Interior. Through legal changes that have now come into force, the Ministry of Interior must be given detailed knowledge about the acquisition of real estate by foreigners and can then react quickly in the event of violations of legal provisions.
According to the latest information from the Ministry of Interior, foreign nationals have purchased around 52,000 hectares of land in Poland since the year 2015/2016.
