Deadlines for implementing the e-delivery service in Poland

Electronic delivery (‘e-delivery’) is a solution that allows correspondence to be sent and received electronically, ensuring equivalent legal effects to sending a registered letter with acknowledgement of receipt. The e-delivery service was introduced by the Act of 18 November 2020 on electronic deliveries, but its implementation has been repeatedly postponed.
In the Announcement of the Minister of Digitalisation of 21 December 2023, it was decided to postpone the implementation date to 1 October 2024. According to the announcements, the date given is to be the final one.
For entrepreneurs, the deadline for the implementation of e-delivery will depend on the date of registration with CEIDG or KRS.

Importantly, public trust professionals, will be obliged to set up an e-delivery address from October 1, 2024.
Entrepreneurs registered until December 31, 2024, in the Central Register and Information on Economic Activity (CEIDG) can submit an application for setting up an e-delivery address at the biznes.gov.pl website.
From October 1, 2024, to June 30, 2025, entrepreneurs will be entitled to submit applications for creating an e-delivery address as part of an application to amend their entry in CEIDG.
Entrepreneurs registering from January 1, 2025, will set up an e-delivery address together with the application for registration of the company in CEIDG.
Entrepreneurs registered in the National Court Register before October 1, 2024, can apply to set up an e-delivery address at biznes.gov.pl. In the case of an entrepreneur (company) registering after 1 October 2024, setting up of an e-delivery address will be done via the service of the Ministry of Justice.
According to an announcement on the gov.pl website, changes to e-delivery are planned for 2024, which will concern, among other things, limits on the size of attachments, changes to the moment of when proof of delivery is issued (currently, the proof is issued when the recipient logs in to the e-delivery box, in future this is to be when the message is read) and notifications in the mObywatel application.
These changes are intended to meet the expectations and needs of users and public entities.
